IDX LOGO AND DISCLAIMERS

IDX Participant’s Web Site shall include the following IDX Logo with each listing that is not currently listed by IDX Participant, regardless of method of display. For example, if IDX Participant’s Web Site includes a single Listing per screen, the IDX Logo must be displayed with the Listing on the screen, or if IDX Participant’s Web Site includes multiple Listings per page, the IDX Logo must be displayed with each Listing on the page.

DISCLAIMER

IDX Participant’s Web Site shall include the following IDX Disclaimer on every page or screen of IDX Participant’s Web Site in which Licensed Data is displayed:

“The data relating to real estate for sale in this web site comes in part from the Internet Data exchange (“IDX”) program of SFAR MLS, Inc. Real estate listings held by brokers other than {Insert IDX Participant’s firm name here} are marked with the IDX Logo. All data in this web site is deemed reliable but is not guaranteed.”

FAIR HOUSING INFORMATION

All real estate advertised herein is subject to the Federal Fair Housing Act and the New Mexico Fair Housing Act, which Acts make it illegal to make or publish any advertisement that indicates any preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, or national origin.

SFAR MLS, Inc. will not knowingly accept any advertising for real estate that is in violation of the law. All persons are hereby informed that all dwellings advertised are available on an equal opportunity basis.

Any print or non-print forms of advertising or other forms of public representations based in whole or in part on information supplied by SFAR MLS must clearly demonstrate the period of time over which such claims are based, and must include the following, or substantially similar, notice:

“Based on Information from Santa Fe Association of REALTORS® MLS for the period (Date) through (Date).

“This representation is based in whole or in part on data supplied by SFAR MLS. SFAR MLS does not guarantee nor is in any way responsible for its accuracy. Data maintained by SFAR MLS may not reflect all real estate activity in the market.”

If other Participants’ sold listings are included on IDX website, the properties not listed or sold by the advertising Participant must be indicated by an asterisk (*) and must include the following disclaimer: “*The asterisked (*) properties were listed and sold by other companies.”
